1. Acceptance of Terms

By accessing and using the ShineAtelier website (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our website located at shineatelier.company (the "Service") operated by ShineAtelier ("us", "we", or "our"). Our Services include residential and commercial cleaning solutions throughout Metro Manila, Philippines.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Services

ShineAtelier provides professional cleaning services including residential cleaning, commercial cleaning, deep cleaning, and specialized maintenance services. Our services are available throughout Taguig, Metro Manila, and surrounding areas.

All cleaning services are performed by trained and vetted professionals using professional-grade equipment and eco-friendly cleaning products. Service appointments are scheduled in advance, and cancellation policies apply as outlined below.

3. User Responsibilities

Clients are responsible for providing safe access to cleaning areas and ensuring that pets are secured during service appointments. Please remove or secure valuable items, documents, and fragile objects before our arrival.

You agree to provide accurate information when booking services, including correct address details, contact information, and any special instructions or requirements for the cleaning service.

Clients must ensure that cleaning areas are accessible and free of hazardous materials. We reserve the right to refuse service or charge additional fees for areas that require extraordinary cleaning efforts due to neglect or unusual conditions.

Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, credit cards, and digital payment methods.

4. Booking and Cancellation Policy

Service appointments must be booked at least 24 hours in advance. Same-day appointments may be available based on our schedule and service area coverage.

Cancellation Policy: Clients may cancel or reschedule appointments with at least 24 hours notice without penalty. Cancellations with less than 24 hours notice will be charged 50% of the scheduled service fee.

No-Show Policy: If our team arrives at the scheduled time and cannot access the property, or if no one is present to provide access, this will be considered a no-show and will incur the full service charge.

Weather-related cancellations or rescheduling will be handled case by case, with flexibility extended to clients during severe weather conditions in Metro Manila.

5. Pricing and Payment Terms

Service pricing is based on property size, service type, frequency, and specific requirements. All prices are listed in Philippine Peso (PHP) and include applicable taxes unless otherwise specified.

Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, major credit cards (Visa, Mastercard), and digital payment platforms (GCash, PayMaya).

For recurring services, invoices are issued monthly and are due within 15 days of the invoice date. Late payments may incur additional fees and service suspension.

Additional charges may apply for extraordinary cleaning requirements, extra rooms beyond the original scope, or special requests not included in the standard service agreement.

6. Privacy and Data Protection

Your personal data is stored securely and will not be shared with third parties except as necessary to provide our services or comply with legal requirements. We implement appropriate security measures to protect your information.

7. Liability and Warranties

ShineAtelier maintains comprehensive liability insurance covering our cleaning services. In the unlikely event of damage to your property during service, please report it within 24 hours so we can address it promptly.

Our cleaning services are provided "as is" and "as available." While we strive for excellence, we cannot guarantee specific outcomes in all situations due to varying property conditions and individual preferences.

Our liability is limited to the cost of the specific cleaning service provided. We are not liable for pre-existing conditions, damage from moisture, wear and tear, or issues arising from insufficient ventilation or maintenance.

Clients are responsible for verifying that our services meet their expectations and for reporting any concerns immediately so we can address them appropriately.

8. Intellectual Property

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. All other trademarks not owned by us that appear on the Service are the property of their respective owners.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our material on our Service without prior written consent.

9. Termination

If you wish to terminate your service agreement, you may simply discontinue using the Service or contact us to formally cancel recurring services. Written notice is appreciated but not required for immediate termination.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be interpreted and governed by the laws of the Republic of the Philippines. Any disputes arising from these terms or your use of the Service will be subject to the exclusive jurisdiction of the courts in Taguig, Metro Manila.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

11. Changes to Terms

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
